OVAL HOME is committed to respecting your privacy, being transparent about our data practices, keeping your data safe, and collecting only data that helps us operate, improve, and protect our products and services.
OVAL HOME designs products and tools that track everyday sleep and sleep-related comfort to empower and inspire users to lead healthier and happier lives. These Terms of Service (Terms) govern your use of:
• OVAL HOME sleep-related devices and electronic comfort monitoring products (Devices);
• OVAL HOME websites located at www.ovalhome.com
• OVAL HOME software (Software); and
• OVAL HOME mobile applications (the Apps).
Devices, Sites, Software, and Apps are collectively the OVAL HOME Service. By accessing or using the OVAL HOME Service, you agree that we may process data we collect from you in accordance with these Terms and the applicable Privacy Policy.
Eligibility and Acceptance
By accessing or using the OVAL HOME Service, you represent and warrant that at least 18 years of age, or the minimum age required by applicable law and have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person or entity, you represent that you have the authority to bind that person or entity to these Terms.
If you do not agree to these Terms, you must not access or use the OVAL HOME Service.
Updates to These Terms
We continuously improve our products and services, so these Terms may be updated from time to time. Future updates will not affect data collected under prior versions. If an update materially changes your rights, we will notify you by email associated with your OVAL HOME account and/or through notice in the App or on the Site.

When we collect data？
Device Activation
When activating an OVAL HOME Device, you may be prompted to download the OVAL HOME App or install Software and provide certain personal information, such as (e.g., date of birth, gender). We use this information to personalize sleep insights and recommendations.
Depending on the Device, it may collect and transmit sleep and comfort data (e.g., sleep duration, sleep quality indicators, related comfort metrics) to OVAL HOME. The full data list for each Device is described in the Product Specifications.
Account Creation
To access Device data, you must create an OVAL HOME account. We may request personal information such as your name, email address, date of birth, and biological sex. Your email address serves as your account username. We do not display your email address to other users.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify OVAL HOME immediately of any unauthorized access to or use of your account.
OVAL HOME is not responsible for any loss or damage arising from your failure to protect your account information.
Information You Add to Your Account
You may add optional information to customize your experience, such as usual bedtime, sleep goals, whether you sleep with a partner or pet, and selected health-related information. We collect and store this data in your account when you provide it.
Site Visits
We collect standard technical and usage data from visitors to our Sites (including visitors without accounts). This may include browser type, operating system, referring URLs, actions taken on the Site, and IP address. We use this information to operate the Sites, prevent misuse, and improve performance.

Device Sync
When you sync your Device via the App or Software, sleep-related data recorded on your Device is transmitted to OVAL HOME servers and associated with your account. Sleep activity may include, but is not limited to: total sleep time, sleep stage estimates, wake events, heart rate, respiration rate, snoring, and sleep onset latency.
We also log technical details of the sync, such as time, connectivity status, and the IP address used for syncing.
Purchases
Payments are processed by third-party payment providers. We store shipping and order information to fulfill purchases. If you are logged into your account when purchasing, the order may be associated with your OVAL HOME account.
Customer Support and Communications
If you contact OVAL HOME for support, we collect your name, email address, and the information you provide so we can assist you and improve the OVAL HOME Service. If you contact us while logged in, certain fields may be pre-filled. Communications on public platforms (e.g., social media) are not private.
Invitations
OVAL HOME may allow you to invite friends to join the OVAL HOME Service by sharing a referral link. Invitations are initiated by you.
Location Features (If Available)
Some OVAL HOME Service features may require the collection of location data (such as GPS signals, Wi-Fi access points, or cell tower identifiers). We collect location data only when you enable a location feature and stop collecting when you disable it. If you use a mapping feature, location data may be shared with a mapping service provider solely to provide the requested map functionality and subject to contractual restrictions.
Permitted Use of the OVAL HOME Service
The OVAL HOME Service is intended for personal, non-commercial use.
Subject to these Terms, OVAL HOME grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:
• access and view OVAL HOME content;
• access and use the Apps and Software; and
• use software embedded in Devices as authorized by these Terms.
You may not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit any part of the OVAL HOME Service except as expressly permitted by these Terms. No rights are granted by implication.
Intellectual Property
All content, software, firmware, designs, trademarks, logos, algorithms, and other intellectual property associated with the OVAL HOME Service are owned by or licensed to OVAL HOME and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, modify, reverse engineer, decompile, disassemble, distribute, or create derivative works from any part of the OVAL HOME Service.
Health and Medical Disclaimer
OVAL HOME devices, software, and services are intended for general wellness and comfort purposes only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Any data, insights, or recommendations provided by the OVAL HOME Service are for informational purposes only and should not be considered medical advice. You should always consult a qualified healthcare professional regarding any medical concerns.
Why we collect data？
We collect and use data to provide, improve, and protect the OVAL HOME Service, including to:
• deliver personalized sleep insights and recommendations;
• communicate service updates and product information (subject to opt-out where applicable);
• conduct research and analysis to improve Devices and services;
• troubleshoot and maintain service quality;
• detect and protect against error, fraud, misuse, or criminal activity; and
• enforce these Terms.
De-identified and aggregated data that does not identify you may be used for research, analytics, marketing, and may be shared with partners or the public.
What data we share？
Data That Could Identify You (PII)
Personally Identifiable Information (PII) includes identifiers such as your name, email, address, or information reasonably linkable to you. We share PII only:
• With service providers performing services on our behalf (e.g., fulfillment, email management, payment processing), who are contractually required to safeguard PII;
• If disclosure is reasonably necessary to comply with law, regulation, valid legal process, or governmental/regulatory requests, to enforce Terms, to protect the security/integrity of the Service, or to protect rights/property/safety; when feasible we will provide advance notice by email unless prohibited by law;
• In connection with sale, merger, bankruptcy, sale of assets, or reorganization, with notice where required, and with continued application of privacy commitments to transferred data.
Data That Does Not Identify You (De-Identified Data)
We may share or sell aggregated, de-identified data that does not identify you for research, reporting, analytics, marketing, or other lawful purposes. We use appropriate procedures to reduce identifiability and contractually prohibit recipients from re-identifying such data.
Data You Direct Us to Share
You may direct us to share data with third parties (e.g., linking your account with third-party apps, health platforms, or other integrations). Once shared, the data is governed by the third party's privacy policy.
Ways You Might Share Your Data
• Default account settings: New accounts default to minimal visibility.
• Contests and giveaways: Data submitted in promotions is handled under these Terms and any additional rules.
• Surveys: Survey data is used for the survey purpose and as stated in applicable notices.
Data Retention
We retain PII for as long as you maintain an OVAL HOME account, or as otherwise necessary to fulfill the purposes described in these Terms, comply with legal obligations, or resolve disputes.、
Access, Correction, and Removal
You can update certain data through account settings. If you remove data, it may no longer appear in your account. Backup copies may remain temporarily in archival systems.
Account Deactivation
You may deactivate your OVAL HOME account by contacting Customer Support. When you do, identifiable data will be removed from the OVAL HOME Service according to our data retention schedule and may persist briefly in archives. OVAL HOME may continue to use de-identified data after account deactivation.
Termination by OVAL HOME
OVAL HOME may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if OVAL HOME reasonably believes such action is necessary to protect the Service, its users, or applicable law.

Children
The OVAL HOME Service is not intended for individuals under the age of 16. We do not knowingly collect PII from children under 16. If you believe a child is using the Service, please contact customer support at support@ovalhome.com.Email Preferences
You may opt out of non-essential emails (e.g., summaries, promotions, surveys) via account settings or unsubscribe links. Opting out does not prevent delivery of essential service-related communications.
Security

Disclaimer of Warranties
THE OVAL HOME SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
OVAL HOME DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OVAL HOME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVAL HOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE OVAL HOME SERVICE.
IN NO EVENT SHALL OVAL HOME'S TOTAL LIABILITY, TO THE EXTENT PERMITTED BY LAW, EXCEED THE AMOUNT YOU PAID TO OVAL HOME FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Do Not Track
Our Sites do not currently respond to browser "Do Not Track" signals.
Third-Party Advertising and Analytics
